Privacy Policy

Welcome to Scout, an online service that makes discovering and managing activities for your kids (“Activities”) as simple as it should be. This Privacy Policy describes the policies and procedures of Scoutitnow LLC (dba Scout) (“we,” “our,” or “us”) on the collection, use, and disclosure of your information on our website  (the “Site”), our mobile application (the “App”), and the services, features, content, applications, and products we offer (collectively, the “Platform” or “Scout”). We do our best to respect your privacy and maintain your trust. To that end, we wrote this Privacy Policy to help you understand how we collect, use, and disclose information in connection with your use of Scout.
 

How You Accept This Policy

Please read this Privacy Policy carefully. If you do not agree with how we handle your information, your choice is not to use Scout. By using Scout (including by creating a user account or reserving  a Activity) you agree to our collection, use, disclosure, and other handling of your information outlined in this Privacy Policy. This Privacy Policy may change from time to time (see below). We consider your continued use of Scout after we make changes as acceptance of those changes, so please check this Privacy Policy periodically for updates. 

Children

We are especially sensitive about children and parent/guardian information. Scout is directed towards parents and guardians, and is not directed towards children under the age of 18. Scout is not intended for the use of children under the age of 18 and we request that children do not provide Personal Information through the Platform. If we learn that we have collected or received Personal Information directly from a child under 18 without parental consent, we will delete that information. If you learn that your child is using Scout or that we have otherwise received information directly from a child under 18, please contact us immediately at info@scoutitnow.com and we will take steps to address it.

As a parent or guardian of a minor child, we will treat any information that you provide us while using Scout on behalf of your minor child as Personally Identifiable Information as otherwise provided in this Privacy Policy.

What Information Do We Collect?

We collect different types of information about you when you use Scout:

  • We collect information about you by which you can be personally identified, such as your name, address, email address, name of your children who will participate in the Activities available through Scout, and telephone number.

  • We may also collect information that is about you but individually doesn’t identify you, such as the date and time of your use of Scout, your IP address, error logs, the websites that you accessed immediately before you access Scout or that you go to immediately when you leave Scout, and the resources that you access and use on Scout. 

  • We also collect information about your internet connection and the equipment that you use when you access Scout, such as the make and model of your device that you use to access Scout, the operating system, and the browser that you use (if you don’t use our App).  

Collectively, we refer to this information as “Personal Information.”

How We Collect Information

We collect Personal Information directly from you when you provide it to us, automatically as you use Scout, and occasionally from third parties, including through Providers (as defined below).

Information we collect directly from you

We collect Personal Information directly from you when you fill out forms on Scout. This includes information provided at the time that you register for an account on Scout, and also when you contact us for further information about Scout, or report a problem with Scout. We may also collect Personal Information from any other communications you may have with us. We also collect your Personal Information and along with other details of your transaction when you sign your child up for an Activity through Scout (when this functionality is made available to you), and when you mark an Activity as a “favorite.” 

If you’re a parent, guardian, or other individual who wants to register for an Activity on Scout (a “Customer” or “user”), you’ll be required to create an account where we’ll ask that you provide various information, including some Personal Information. For example, we may collect information, including your name, address, phone number, email, child’s name and birthday, as well as any other information you provide to us. We may also collect other Personal Information at the request of with the provider of the Activity.

When you register for an account or register your child for an Activity, you may be required to provide financial information, such as a credit or debit card number. If you are required to provide this, you should understand that this information is sent directly to our payment processor. Our payment processor stores your financial account information and we may only receive a “token” that identifies you with our payment processor for further payments (if any). This “token” does not contain your actual credit or debit card information and can only be used by us to process further payments for access to Scout or for paying for an Activity. 

If you are a 3rd party partner who partners with Scout to ensure your offerings of children’s classes, camps, or other services (a “Provider”), we ask for your name, address, phone number, email, and other information about your business or service, as well as names and email addresses of individuals authorized to use your account. 

If you contact us via email or by some other means (either through our App or Site), we may keep a record of your contact information and correspondence for later reference.

 

We anonymize any information you may provide us in your responses to surveys that we may ask to help us understand how our users use Scout and how we can improve it. 

Information We Automatically Collect

We automatically collect information about you as you navigate and interact with Scout through automatic data collection technologies that collect information about your equipment and other browsing activities on Scout. This includes the type of computer or mobile device you use; your device’s unique identifier; IP Address; MAC address; and your device’s operating system and physical location (including geolocation, beacon based location, and GPS location); information in error and security logs; the websites that you accessed immediately before you access Scout or that you go to immediately when you leave Scout; and the resources that you access and use on Scout. While this information is generally anonymous by itself, sometimes it may include Personal Data or we may maintain it or associate it with Personal Data we collect in other ways or receive from third parties. This information is used to help us improve Scout and deliver more personalized service to you by enabling us to estimate our users and usage patterns and store information about your preferences, allowing us to customize Scout according to your individual interests. We describe our automatic collection practices in more detail below. 

Cookies, Web Beacons, and Local Storage

Scout may incorporate technology for automatic data collection such as cookies, web beacons, pixel tags, and local storage to collect and store information.

Cookies

Cookies are small files that may be placed on your computer when you visit a website or online Service. For Scout, we use cookies to help identify and track usage of the Platform, and to make it easier to deliver a personalized experience. You can easily refuse our cookies or receive an alert when cookies are being sent by adjusting the preferences in your browser. However, be forewarned that disabling cookies may cause Scout to not operate properly. You can find more information about cookies at http://www.allaboutcookies.org and http://youronlinechoices.eu.

Web Beacons

Web beacons are tiny graphic objects embedded in a web page or email, which allow us to check that a user has viewed a page on Scout or an email.

We may use web beacons alone or in conjunction with cookies to compile information about engagement with Scout and our communications. Web beacons may be used within Scout to track email open rates, web page visits, or form submissions. In some cases, we tie the information gathered by web beacons to Personal Information. For example, we use clear gifs in our HTML-based emails to let us know which emails have been opened by recipients. This allows us to gauge the effectiveness of certain communications and the effectiveness of our marketing campaigns.

Flash and HTML5 Local Storage

We may use local shared objects, such as Flash cookies, or local storage objects, available using HTML5, to store information and preferences on your computer. Third Parties Services (defined below) may also provide certain features on our Platform to display advertising based upon your web browsing activity that also use Flash cookies or HTML5 to collect and store information.

Third-Party Services

To run Scout, we utilize various third-party products (collectively “Third Party Services” and individually a “Third Party Service”), such as analytics software and social media services like Facebook connect. If you authorize us to connect with a Third Party Service, you grant us permission to collect certain Personal Information, such as your name, email address, phone number, and any other information that the Third Party Service may make available to us. We use and disclose any collected information in accordance with our Privacy Policy.

Please note that your use of a Third Party Service is governed by the service’s respective terms of service and privacy policies. Our Privacy Policy does not address, and we are not responsible for, the privacy, information, or other practices of any third parties, including our Providers.

Analytics Software

Third-party analytics software and tools help us gather certain information automatically and store it for analytical purposes. These services generally collect information that includes how often you visit Scout, what areas of Scout you visit, and what other sites or services you used prior to using Scout.

For example, we use Google Analytics, which relies on cookies and other, similar technology to collect and analyze information about use of the Platform and report on activities and trends. This service may also collect information regarding the use of other websites, apps and online resources. You can learn about Google’s practices by going to www.google.com/policies/privacy/partners/, and opt out of them by downloading the Google Analytics opt-out browser add-on, available at https://tools.google.com/dlpage/gaoptout.

Social Media Features

Scout also includes social media features such as the Facebook “Like” button, and widgets, such as the “Share” button . These features collect various information, including your IP address, the areas of Scout you visit, and also may set cookies in order to function properly. Social media features and widgets are either hosted by a third party or hosted directly on Scout. The information collected through social media features and widgets is subject to the social media company’s privacy notice. 

User Authentication Services

We use sign-in services such as Facebook Connect and OpenID to streamline the registration process. These services authenticate your identity and provide you with the option to share certain Personal Information with us such as your name and email address to pre-populate our sign up form. Services like Facebook Connect also give you the option to post information about your activities on our website to your profile page to share with others within your network. While the information we collect from your use of these sign-in services is governed by this Privacy Policy, if you use the optional features to provide information to these services (like Facebook Connect), the information provided to them will be subject to their privacy policies. 

Information we Receive From Third Parties

In addition to the above ways we collect information, we may receive information about you from other sources, such as public databases, strategic and joint marketing partners, social media platforms, people with whom you are friends or otherwise connected on social media platforms, as well as from other third parties. For example, if you elect to connect your social media account to your Scout account, certain information from your social media account may be shared with us, including information that’s part of your profile or your friends’ profiles. We may also collect information about you when you communicate with us on social media platforms, such as by posting on our page or communicating through us through the social media chat functions. 

 

How We Use the Information We Collect

We may use your Personal Information in various ways. 

Your Personal Information will be used to: respond to your inquiries and fulfill your requests; to send administrative information to you (for example, information regarding our services and changes to our terms, conditions, and policies); and to complete and fulfill your registration in or purchase of an Activity (for example, to process your payments, communicate with you regarding your purchase, and provide you with related customer service). We may also use your Personal Information to in any other way we may describe to you when you provide us the information; to fulfil another other purpose for which you provide us the Personal

Information; or for any other purpose with your consent. 

We use anonymized and/or aggregated information to administer and maintain Scout; to understand the demographics of our user base; to understand how our users use and interact with Scout; develop new products and services or enhance, improve or modify our existing products and services; identify and analyze usage trends; determine the effectiveness of our promotional campaigns; and operate and expand our business activities. We may also use Personal Information that we collect for other business purposes, such as to carry out our obligations and enforce our rights regarding your use of Scout (including to enforce our Terms of Use); data analysis; audits; fraud monitoring and prevention.

We may also use your Personal Information to send you marketing communications that we believe may be of interest to you, such as a newsletter. If you do not want to receive these communications, you may unsubscribe from them at any time as described below. 

Disclosure of Personal Information to Third Parties

We do not share, sell, or otherwise disclose your Personal Information for purposes other than those outlined in this Privacy Policy. However, we may disclose aggregated information, and information that does not identify any individual (including anonymized Personal Information) without restriction. 

We may disclose Personal Information that we collect about you:

  • To third-party service providers who provide services such as website hosting, data analysis, payment processing services, order fulfillment, information technology and related infrastructure provision, customer service, email delivery, credit card processing, auditing, and other similar services.   • To our Providers, when you register or purchase an Activity from them; 

  • To your friends or followers associated with your social media account (or anybody else who can see your social media account based on your social media account’s privacy settings), as well as to your social media account provider, in connection with your social sharing activity, such as if you connect your Facebook account to your Scout account; 

  • To fulfill any other purpose for which you provide the information. For example, if you ask us to share information about an Activity with a friend, we will transmit the information about the Activity along with any other comments you may provide to the recipient;

  • To a potential or actual buyer or other successor in the event of a planned or actual merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of a bankruptcy, liquidation, or similar proceeding, in which Personal Information held by us about the users of Scout are among the assets transferred;

  • As required by law, such as to comply with a subpoena, or similar legal process;

  • When we believe in good faith that disclosure is necessary to protect our rights, property, or safety or that of our other users, Providers, or others, including to investigate fraud;

  • To enforce our Terms of Use and other agreements, including for billing and collection purposes or for the establishment, exercise, or defense of legal claims;

  • For any other purpose disclosed by us when you provide the information; or 

  • With your consent.

We do not control the use of your information collected by third parties described above. Whenever possible, these organizations are under contractual obligations to use this data only for providing the services to us and to maintain this information strictly confidential. However, these third parties may aggregate the information they collect with information they collect from their other customers for their own purposes as long as the aggregated information can no longer be used to identify you or any other user.

 

What Personal Information Can You Access or Change?

If you would like to review, correct, update, or delete any of your Personal Information, you can log into Scout and modify or update your information, or you can contact our customer support through the contact information listed below. For all other requests, you may contact our customer support for assistance. 

In your request, please make clear what Personal Information you would like to have changed or removed from our database. For your protection, we may only implement requests with respect to the Personal Information associated with the particular email address that you use to send us your request, and we may need to verify your identity before changing or removing any information. We will try to comply with your request as soon as reasonably practicable, however we may not be able to accommodate your request if we believe it would violate any law or legal requirement, or cause the information to become incorrect. 

Even if you disable your account, or change your Personal information, we may need to retain certain information for recordkeeping purposes or to complete any transactions that you began prior to requesting such change or deletion (e.g., when you make a purchase, you may not be able to change or delete the Personal Information provided until after the completion of such purchase). There may also be residual information that will remain within our databases and other records, which will not be removed so that Scout will continue to function properly or because it would be burdensome to delete.

Choices About How We Use and Disclose Your Information

We know you want to be in control over your Personal Information as much as possible. That why provide you with choices regarding the Personal Information we collect on Scout. 

Marketing Communications from Us

If you do not wish to have your contact information used by us to promote our own or our Providers’ products and services, you can opt-out by contacting us through the contact information below and ask that you be removed from our marketing lists. In addition, if we have sent you a promotional email, you may ask to be omitted from future marketing communications simply by clicking the unsubscribe link in that email. This opt-out does not apply to non-promotional communications we send you, including those as a result of a registration or purchase of an Activity or communications about your Activity experience. 

Advertising Networks

We may partner with third party ad network(s) and other service providers to show you relevant ads, including ads displayed on Scout and on other companies’ websites or apps, on any of your devices. These ad networks may use cookies and web beacons to collect information about your activities on Scout and other web sites and mobile apps to provide you targeted advertising based upon your interests. They may also use these technologies, along with activity information they collect, to recognize you across the devices you use, such as a mobile device and a laptop or other computer.

If you do not wish to have this information used for the purpose of serving you targeted ads, you may opt-out. You will continue to receive advertisements that are not based on your online activities.

Contact by Providers

If you are a Customer of one of our Providers and would no longer like to be contacted by a Provider, or would like to access, correct, amend, or delete inaccurate Personal Information held by a Provider, please contact the Provider that you interact with directly.

How We Respond To Do Not Track Signals

Some web browsers (including Safari, Internet Explorer, Firefox, and Chrome) incorporate a “Do Not Track” (DNT) or similar feature, which provides websites with a signal that a visitor does not want to have his/her online activity and behavior tracked. If an online service elects to respond to a particular DNT signal, the service may refrain from collecting certain personal information about that browser’s user. Not all browsers offer a DNT option and there is currently no industry consensus as to what constitutes a DNT signal. For these reasons, many website operators, including Scout, do not modify what information we collect or how we use that information or take any other action to respond to DNT signals. Data Security

The security of your Personal Information is a high priority for us. We maintain Scout and all associated data with technical, administrative, and physical safeguards designed to protect against loss, unauthorized access, destruction, misuse, modification, and improper disclosure. The safety and security of your information also depends on you. Where you have registered for an account on Scout, you are responsible for keeping your password to your Scout account confidential. We ask that you do not share your password with anyone outside of your family and your family caregivers. 

Unfortunately, no data transmission or storage system can be guaranteed to be 100% secure. If you have any questions about the security of your interaction with us (if, for example, you feel that the security of any account you might have with us has been compromised), you can contact us at info@scoutitnow.com.

We Reserve the Right to Update and Revise This Privacy Policy at Any Time

We occasionally review this Privacy Policy to make sure it complies with applicable law and conforms to changes in our business. We may need to update this Privacy Policy, and we reserve the right to do so at any time. If we revise this Privacy Policy, we will do our best to notify you, as required by law, and will update the "Effective Date" at the top of this page so that you can tell if it has changed since your last visit. Please review this Privacy Policy regularly to ensure that you are aware of its terms. Any change to this Privacy Policy will become effective when we post the revised Privacy Policy. You are responsible for ensuring that we have an up-to-date, active, and deliverable email address for you, and for periodically visiting Scout and this Privacy Policy to check for any changes. Your use of Scout after any we post any revisions constitutes your acceptance to the new Privacy Policy.

International Users and Visitors

Scout is hosted in the United States, and is not intended to be subjected to the laws or jurisdiction of any state, country or territory other than that of the United States. Your Personal Information may be stored and processed in any country where we have facilities or in which we engage service providers, including the United States. These countries may have different data protection rules than those of your country. The federal, state, and local governments, courts, or law enforcement or regulatory agencies may be able to obtain disclosure of your information through the laws of those countries. By using Scout, you represent that you have read and understood the foregoing and hereby consent to the ,storage and other processing of your Personal Information in countries outside of your country of residence, including the United States.
